(a) To participate in the Medical Transportation Program
(MTP), all individual transportation participants (ITP) must:
(1) submit a complete ITP application to the Health
and Human Services Commission (HHSC) or its designee to acquire participation
status; and
(2) have and maintain a current driver's license, current
vehicle insurance, current vehicle inspection sticker, and current
vehicle license tags and meet all other participation requirements.
(b) In addition to the requirements in subsection (a)
of this section, ITPs applying to receive mileage reimbursement for
transporting eligible MTP clients other than themselves or their family
members are subject to:
(1) Chapter 352 of this title (relating to Medicaid
and the Children's Health Insurance Program Provider Enrollment) and
Chapter 371 of this title (relating to Medicaid and Other Health and
Human Services Fraud and Abuse Program Integrity), as applicable;
(2) §380.502(1) - (3) of this chapter (relating
to Standards for Motor Vehicle Operators); and
(3) any additional validation processes specified by
HHSC or its designee as a condition of participation.
(c) HHSC may reject any application for participation
as an ITP or terminate the participation status of any ITP at HHSC's
sole discretion.
(d) To receive mileage reimbursement for a trip, an
ITP must return to HHSC or its designee a completed ITP service record
(Form H3017) or its equivalent.
(e) The ITP must refund to HHSC or its designee any
funds to which the ITP is not entitled for any reason.
