| (a) An RMA may request the commission to designate a highway project as a part of the state highway system. The commission may approve the request if: (1) the commission determines that the project can be efficiently integrated into the state highway system; (2) the RMA agrees to design, construct, maintain, and operate the project in accordance with standards established by the department, and to be subject to department reviews and approvals as deemed necessary by the department; and (3) the RMA agrees to be responsible for all EPIC. (b) The RMA and the department may agree to allocate maintenance or operation responsibilities to the department. |
