| (a) The governing body of a political subdivision associated
with a former participating department may delegate the duties required
by such governing body under §864.010, Texas Government Code,
to the executive director by providing a written request to delegate
such duties to the executive director.
(b) In the event the governing body of the political
subdivision associated with a participating department that discontinues
its participation in the pension system or ceases to exist fails to
perform the duties required by such governing body under §864.010,
Texas Government Code, for a period of 12 months or more and does
not otherwise elect to delegate its duties to the executive director
pursuant to subsection (a) of this section, the governing body of
the political subdivision will be deemed to have designated its duties
to the executive director, and the executive director is authorized
by the state board to perform the duties of such governing body.
(c) A one-time administrative penalty of $2,500 is
imposed on the governing body of the political subdivision associated
with the department that delegates its duties, or whose duties are
delegated, in accordance with this section.
(d) The participating department head, if any, or the
governing body of the political subdivision shall provide the executive
director with any information that is requested by the executive director
in order to carry out the duties delegated to the executive director
under this section, including, without limitation, copies of all membership
records for members and retirees and the minutes of all local board
meetings.
