Preamble Texas Admin Code Rule
(a)Except for contingent dismissals, all [ All] agreements between or among parties that are reached as a result of Alternative Dispute Resolution must be committed to writing, signed by the respondent or applicant and a Board staff attorney and submitted to the Board for approval. Once signed by the Board, the agreement will have the same force and effect as a written contract.

(b)If the Board does not approve a proposed settlement, the respondent or applicant will be so informed and the matter will be referred to the Director of Standards and Enforcement to pursue appropriate action.

The agency certifies that legal counsel has reviewed the proposal and found it to be within the state agency's legal authority to adopt.
