(a) The executive director shall provide funding for
the Low Income Vehicle Repair Assistance, Retrofit, and Accelerated
Vehicle Retirement Program (LIRAP) with available funds from fees
collected under §114.53 of this title (relating to Inspection
and Maintenance Fees) or other designated and available funds from
participating counties.
(b) The program shall be administered in accordance
with Texas Government Code, Chapter 783. Programmatic costs may include
call-center management, application oversight, invoice analysis, education,
outreach, and advertising.
(c) A participating county shall receive, to the extent
practicable, funds appropriated for the program in reasonable proportion
to the amount in fees collected in the participating county or area
from emissions testing fees designated by the commission.
(d) In a county with a vehicle emissions inspection
and maintenance program under Texas Health and Safety Code, §382.202
or §382.302, not more than 10 percent of the money provided for
LIRAP may be used for administration of the program.
