(a) Upon approval of an application by the executive
director, the successful completion of the requirements of a Corrective
Action Plan (CAP), or the successful completion of the requirements
of the Licensing Committee and full board in a manner provided in
this subchapter, the executive director shall:
(1) issue a registration subject to the applicant's
taking and passing the examination on the principles and practice
of surveying according to §134.67 of this chapter (relating to
Examination on the Principles and Practice of Surveying); or
(2) issue a registration to an applicant who has passed
the examination on the principles and practice of surveying; and
(3) report all approved applications to the Board.
(b) The board will consider applications presented
to it and recommendations it receives from the Licensing Committee.
(c) The executive director shall advise the applicant
in writing of any decision of the executive director, the Licensing
Committee, or the board, as applicable, within 20 days of the decision.
(d) An applicant whose application has been denied
by the Board based on criminal conviction shall have 20 days from
the date of the denial within which to request in writing a hearing
at the State Office of Administrative Hearings (SOAH).
