(a) The comptroller may set fees, service charges,
and penalties to be charged a depository account holder for services
or activities regarding a depository account, including fees for an
overdraft, an insufficient fund check or draft, or a stop payment
order. The comptroller may set or change the fees established under
this rule by publishing the applicable fees on the depository website
and by sending a notice of any change in fees to depository account
holders. The notice may be sent electronically.
(b) The depository may without notice to or consent
of the depository account holder suspend withdrawal privileges for
a depository account or liquidate all or any portion of a depository
account to the extent necessary to satisfy any unpaid fees, service
charges or penalties as outlined in the depository account agreement
or as provided in §14.12 of this title (relating to Applicability
of Estates Code).
