(a) Each grant application from a county must include
a resolution from the county commissioners' court that contains the
following:
(1) authorization for the submission of the application
to the Commission;
(2) provision giving the authorized official the power
to apply for, accept, decline, modify, or cancel the grant; and
(3) written assurance that, in the event of loss or
misuse of grant funds, the governing body will return all funds as
required by the Commission.
(b) Each grant application from an eligible entity
that is not a local government or state agency must submit a resolution
adopted by the entity's governing board that contains the following:
(1) authorization for the submission of the application
to the Commission;
(2) provision giving the authorized official the power
to apply for, accept, decline, modify, or cancel the grant;
(3) designation of the financial officer for the grant,
who may not be the same person as the authorized official; and
(4) written assurance that, in the event of loss or
misuse of grant funds, the governing body will return all funds as
required by the Commission.
