The rules in this division do not apply to: (1) an action of the Commission for which a contractor is entitled to a specific remedy pursuant to state or federal constitution or statute; (2) contracts between the Commission and the federal government or its agencies, another state or another nation; (3) contracts between the Commission and a local governmental body, or a political subdivision of another state; (4) contracts between a subcontractor and a contractor, when neither the contractor or the subcontractor is the Commission; (5) contracts within the exclusive jurisdiction of state or local regulatory bodies other than the Commission; or (6) contracts within the exclusive jurisdiction of federal courts or regulatory bodies. |
