(a) The governing body of a municipality by ordinance
may elect to have the commission exercise exclusive original jurisdiction
over the utility rate, operation, and services of utilities, within
the incorporated limits of the municipality. The governing body of
a municipality that surrenders its jurisdiction to the commission
may reinstate its jurisdiction by ordinance at any time after the
second anniversary of the date on which the municipality surrendered
its jurisdiction to the commission, except that the municipality may
not reinstate its jurisdiction during the pendency of a rate proceeding
before the commission. The municipality may not surrender its jurisdiction
again until the second anniversary of the date on which the municipality
reinstates jurisdiction.
(b) The commission shall post on its website a list
of municipalities that surrendered original jurisdiction to the commission.
