(a) Certified organic and/or transitional citrus producers
in active pest management zones may negotiate and enter into voluntary
indemnification agreements with the Corporation provided that those
agreements are negotiated and made in good faith by both parties and
are approved by the Commissioner.
(b) Until each respective zone is declared eradicated
by the Commissioner, certified organic and/or transitional citrus
producers in pest management zones that are active at the time this
rule becomes effective will be eligible for compensation under the
following conditions. The citrus producer must have planted certified
organic or transitional citrus during or prior to the effective date.
(c) Certified organic and/or transitional citrus producers
in pest management zones which become active after the effective date
of this subchapter will be eligible for compensation under the following
conditions. The citrus producer must have an application for transitional
or organic citrus approved by either the Department's Organic Certification
Program or a third-party certifier at least one year before the date
a referendum is held establishing a suppression program and assessment
and approving a budget for that pest management zone.
