(a) The office is required to transfer a committed
person to a more restrictive setting if the office considers the transfer
necessary to further treatment and to protect the community.
(b) In such an instance, when the office has determined
that it is necessary to transfer a committed person to a more restrictive
setting in order to further the person's supervision and treatment,
the office may issue an emergency detention order.
(c) The emergency detention order shall authorize a
peace officer to immediately apprehend the individual and transport
the individual to a location designated by the office.
(d) The emergency detention order shall list the individual's
name and identifying details, current location, location to which
the person shall be transferred and shall be signed by the office's
Executive Director or designee.
