(a) Definitions. The following words and terms, when
used in this chapter, shall have the following meanings, unless the
context clearly indicates otherwise.
(1) Emergency situation--An emergency caused by a natural
or manmade disaster or any other exceptional situation that causes
an extraordinary demand for pharmacist services.
(2) State--One of the 50 United States of America,
the District of Columbia, and Puerto Rico.
(b) Emergency Temporary Pharmacy Technician Registration.
In an emergency situation, the board may grant a pharmacy technician
who holds a current registration in another state an emergency temporary
pharmacy technician registration to practice in Texas. The following
is applicable for the emergency temporary pharmacy technician registration.
(1) An applicant for an emergency temporary pharmacy
technician registration under this section must hold a current pharmacy
technician registration in another state and that registration and
other registrations held by the applicant in any other state may not
be suspended, revoked, canceled, surrendered, or otherwise restricted
for any reason.
(2) To qualify for an emergency temporary pharmacy
technician registration, the applicant must submit an application
including the following information:
(A) name, address, and phone number of the applicant;
and
(B) any other information the required by the board.
(3) An emergency temporary pharmacy technician registration
shall be valid for a period as determined by the board not to exceed
six months. The executive director of the board, in his/her discretion,
may renew the registration for an additional six months, if the emergency
situation still exists.
(c) Exception. This section is not applicable to pharmacy
technicians enrolled in a volunteer health registry maintained by
the Texas Department of State Health Services.
