(a) The executive secretary or a Commissioner may present to
the Commission a suggested new rule, amendment to an existing rule, or repeal
of a rule.
(b) The executive secretary shall provide a copy of each suggested
new rule, amendment to an existing rule, or repeal of a rule to each Commissioner
before the Commission meeting at which the rule will be considered.
(c) If the Commission votes to propose a suggested new rule,
amendment to an existing rule, or repeal of a rule, the executive secretary
shall file the proposal with the Secretary of State for publication in the
Texas Register in accordance with the Administrative Procedure Act, Government
Code, Chapter 2001.
(d) Contemporaneously with filing with the Texas Register,
the executive secretary shall distribute a copy of each proposal to each association.
On receipt of a proposal, an association shall promptly post the proposal
in a prominent place that will ensure access by interested persons.
(e) The documentation filed with the Secretary of State for
publication in the Texas Register and the transcript of the Commission meeting
at which a rule is finally adopted constitutes the Commission's order adopting
the rule.
