(a) Biosolids.
(1) Bulk biosolids or biosolids sold or given away
in a bag or other container shall not be land applied if the concentration
of any metal in the biosolids exceeds the ceiling concentration for
the metal in Table 1 of subsection (b) of this section.
(2) If the bulk biosolids are applied to agricultural
land, forest, a public contact site, or a reclamation site, either:
(A) the cumulative loading rate for each metal shall
not exceed the cumulative metal loading rate for the metal in Table
2 of subsection (b) of this section; or
(B) the concentration of each metal in the biosolids
shall not exceed the concentration for the metal in Table 3 of subsection
(b) of this section.
(3) If bulk biosolids are applied to a lawn or a home
garden, the concentration of each metal in the biosolids shall not
exceed the concentration for the metal in Table 3 of subsection (b)
of this section.
(4) If biosolids are sold or given away in a bag or
other container for land application, either:
(A) the concentration of each metal in the biosolids
shall not exceed the concentration for the metal in Table 3 in subsection
(b) of this section; or
(B) the product of the concentration of each metal
in the biosolids and the annual whole application rate for the biosolids
shall not cause the annual metal loading rate for the metal in Table
4 of subsection (b) of this section to be exceeded. The procedure
used to determine the annual whole application rate is presented in §312.49
of this title (relating to Procedure to Determine the Annual Whole
Application Rate for Biosolids and Domestic Septage).
