(a) Except as provided in subsection (b) of this section,
a facility that receives food from an off-site source shall maintain
a copy of any permit and/or license required by the local health department
or the Texas Department of State Health Services. The transfer of
such food to the facility shall be conducted in a manner to prevent
contamination or adulteration.
(b) If the facility receives food from an off-site
source on a special occasion, the facility is not required to maintain
a copy of any required permits or licenses for the additional off-site
source. The facility shall not accept food from residents' family
members.
