(a) The commission shall have primary responsibility
for policy-making activities including but not limited to:
(1) setting fees;
(2) adopting rules;
(3) imposing sanctions and penalties; and
(4) issuing final orders in contested cases.
(b) The commission shall have the sole responsibility
for the adoption of rules proposed by the department or the commission.
(c) The commission shall provide reasonable accommodations,
as required by the Americans with Disabilities Act of 1990, Public
Law 101-336 and any subsequent amendments, for the public to participate
in the programs regulated by the department.
(d) Upon request, the commission shall provide reasonable
access to persons who do not speak English to the programs regulated
by the department.
