(a) The provisions of this subsection apply only to
a person in possession of a license purchased through an automated
point-of-sale system and do not apply to a digital license issued
by the department pursuant to §53.3(a)(12) of this title (relating
to Combination Hunting and Fishing License Packages), §53.4 of
this title (relating to Lifetime Licenses) or §53.5(a)(3) of
this title (relating to Recreational Hunting License, Stamps, and
Tags).
(1) A person who kills a white-tailed deer shall complete,
in ink, the harvest log on the back of the hunting license immediately
upon kill.
(2) Completion of the harvest log is not required for
deer taken:
(A) under the provisions of §65.29 of this title
(relating to Managed Lands Deer Program (MLDP));
(B) by special permit under the provisions of Subchapter
H of this chapter (relating to Public Hunting Proclamation) on department
lands;
(C) on department-leased lands under the provisions
of Parks and Wildlife Code, §11.0272; or
(D) by special antlerless permit issued by the U.S.
Forest Service (USFS) for use on USFS lands that are part of the department's
public hunting program.
(b) The provisions of this subsection apply to any
person in possession of a license lawfully purchased by any means
other than through an automated point-of-sale system.
(1) A person who takes a white-tailed deer, mule deer,
Rio Grande turkey, or Eastern turkey shall complete, in ink, the harvest
log on the back of the hunting or fishing license, as applicable,
immediately upon kill.
(2) Completion of the harvest log is not required for
deer taken under the provisions of subsection (a)(2) of this section.
