(a) For a licensed general residential operation, the
permit holder must ensure compliance with the minimum standards in
this chapter at all times, with the exception of those minimum standards
identified for specific types of services that your operation does
not offer. For example, if we license your operation to offer emergency
care services only, you do not have to comply with the minimum standards
that apply to treatment services for a child with an emotional disorder,
treatment services for a child with an intellectual disability, or
a transitional living program; however, you must comply with all other
applicable minimum standards of this chapter.
(b) For an unlicensed general residential operation
that is subject to Licensing's regulation, the operation's administrator,
owner, or operator or any other controlling person who has the ability
to influence or direct the operation's management, expenditures, or
policies must ensure compliance with all minimum standards in this
chapter at all times, with the exception of those minimum standards
identified for specific types of services that the unlicensed operation
does not offer.
