(a) Within this subchapter a digital signature may be used
to authenticate a written electronic communication sent to the Agency if it
complies with the following factors:
(1) it is unique to the person or individual using it;
(2) it is capable of independent verification;
(3) it is under the sole control of the person or individual
using it; and
(4) it is transmitted in a manner that shall make it infeasible
to change the data in the communication without invalidating the digital signature.
(b) In this section, digital signature means an electronic
identifier intended by the person or individual using it to have the same
force and effect as the use of a manual signature.
