(a) Annual examination. A licensed breeder shall have
each animal used for breeding examined by a veterinarian at least
once in every twelve month period. The annual examination required
by this section must be conducted in accordance with practices established
under the Veterinary Licensing Act, Occupations Code Chapter 801,
and documented by a veterinarian in the medical records related to
each animal.
(b) Euthanasia and surgical procedures. Only a veterinarian
shall be allowed to euthanize an animal or perform a surgical birth.
(c) Routine and preventive care. A licensed breeder
shall develop and maintain at each of the breeder's facilities a written
health care management protocol as required by this section that is
approved by a veterinarian and that addresses routine and preventive
healthcare for each animal in the facility.
(1) The breeder shall ensure that the protocol is followed,
and that routine and preventive healthcare is provided to each animal
in the facility and that each animal receives appropriate care and
treatment for any injury, disease, or illness that may affect the
animal's health or well-being.
(2) The written health care management protocol required
by this section must contain all health care records required by this
chapter including all exemptions authorized by this chapter and approved
by a veterinarian.
(3) On transfer or sale of the animal, a copy of the
written health care management protocol required by this section must
be transferred with the animal and the original records retained by
the licensee.
(d) Breeding cycles. A licensed breeder shall provide
breeding females adequate rest between breeding cycles as recommended
by a veterinarian based on the breed, age, and health of the individual
breeding female and documented by a veterinarian in the medical records
related to each animal.
