(a) Timely applications. If a licensee submits a timely and
sufficient application for new annual registration permit, the existing permit
does not expire until the application has been finally determined by the agency.
If the application is denied or the terms of the new permit are limited, the
existing permit does not expire until the last day for seeking review of the
agency order or a later date fixed by order of the reviewing court.
(b) Late applications. A licensee must submit an application
for an annual registration permit in a timely manner. A licensee shall be
provided written notice at the licensee's address of record at least 30 days
prior to the expiration date of the permit. Failure to submit an application
for the permit by the appropriate deadline shall render the license invalid.
If a permit is expired for more than one year, the license shall be considered
canceled and may not be renewed. The board shall formally cancel the license
at the next scheduled meeting of the board.
(c) Temporary suspensions. Nothing in this rule may be construed
to violate or contradict the temporary suspension provisions of §164.059
of the Act.
