(a) For the purpose of certifying to the Board that
an applicant has reviewed the owners of the entity as required by
the AMC Act and that no such owner has had a license to act as an
appraiser denied, revoked, or surrendered in lieu of revocation unless
the license was subsequently granted or reinstated, the applicant
may rely on the Appraisal Subcommittee's online National Registry
database.
(b) If an owner of the applicant has had a license
to act as an appraiser denied, revoked, or surrendered, the Board
may require the applicant to demonstrate that the owner's license
was denied, revoked, or surrendered for a nonsubstantive reason as
determined by the Board.
(c) For purposes of this Chapter, a nonsubstantive
reason may include, but is not limited to:
(1) mistake; or
(2) failure to comply with technical requirements for
renewal.
