RULE §357.583Statutory Bases

The statutory bases for Medicaid fraud and abuse investigation and prosecution are Texas Human Resources Code, Chapter 32, and 42 United States Code §§1396b(q) and 1396h. State and federal officials may also act under other statutes, including, but not limited to, the Deceptive Trade Practices and Consumer Protection Act, the Texas Penal Code, the Civil Monetary Penalties Law, and Public Law 100-93.
