| (a) The Texas Health and Human Services Commission (HHSC) may include together in a TANF certified group: (1) each dependent child; and (2) each relative of a dependent child: (A) living with the child in a family setting being established or maintained as shown by the relative through continuing responsibility for the child's day-to-day care; and (B) whose relationship to the child, by blood, marriage, or adoption extends up to the degree indicated in §372.108 of this division (relating to Relationship Requirement). (b) HHSC may continue to include a person in a certified group after the person has entered a nursing facility, so long as HHSC determines the person's stay in the nursing facility is temporary. |
