RULE §79.3Receipt of Letters and Documents

(a) An employee of the secretary of state will stamp all letters or documents received in the Corporations Section with the date of receipt. The hour of receipt is not noted.

(b) Mail is not received in the Corporations Section until it has been brought from the post office or otherwise hand-delivered to the Office of the Secretary of State. A postmark, a date generated on a letter or document solely as a result of its electronic transmission, or a date placed on a letter, document, or envelope by some person other than an employee of the secretary of state cannot be considered as the date of receipt.

(c) Documents transmitted by fax after office hours are received the next business day or when actually received by an employee of the secretary of state.
