(a) The Department's Governing Board (the "Board")
may waive rules in this chapter for good cause to meet the purpose
of the Homeless Programs described further in §7.1 of this title
(relating to Purpose and Goals). However, any waiver cannot conflict
with the federal statutes or regulations, the Department's Action
Plan, or state statutes governing any of the Homeless Programs.
(b) A provision of a closed NOFA may not be waived
except in the case of a disaster as described in §1.5 of this
title (related to Waiver Applicability in the Case of Federally Declared
Disasters) or a change in federal law that makes adherence to the
requirements of the NOFA impossible or impracticable as determined
by the Board.
