| RULE §11.166 | Notice of Existing Unsuitable Designation |
Within 10 days following receipt of an application for a surface mining permit covering an area on which a designation of unsuitability for surface mining has been made by the commission, the commission shall provide to the applicant a copy of such determination. Applicant may thereafter amend the application to eliminate any land covered by the designation. |
