RULE §11.21Who May Appear

(a) Any person or agency interested in a petition to declare lands unsuitable for surface mining or petition for adoption of rules may appear formally before the commission.

(b) In all regularly docketed cases, a person affected in a permit application proceeding and any other person or agency interested in a proceeding to designate lands as unsuitable for surface mining activities, or to have such a designation terminated or petition for adoption of rules, may be permitted to appear in support of or in opposition to all or part of the remedy sought in the particular proceeding by filing notice of intent to participate at least five days in advance of the hearing date, and may present any relevant and proper testimony and evidence bearing upon the issues involved in the particular proceeding.
