(a) If the Commission does not receive a protest to
an application submitted under this subchapter, the director may administratively
approve the application if the application otherwise complies with
the requirements of this subchapter.
(b) The director may administratively deny the application
if it does not meet the requirements of this subchapter or other laws,
rules, or orders of the Commission. The director shall provide the
applicant written notice of the basis for administrative denial.
(c) The applicant may request a hearing upon receipt
of notice of administrative denial. A request for hearing shall be
made to the director within 30 days of the date on the notice of administrative
denial. If the director receives a request for a hearing, the director
shall refer the matter to the Office of General Counsel for assignment
of a hearings examiner who shall conduct the hearing in accordance
with Chapter 1 of this title (relating to Practice and Procedure).
