(a) The director may require a permit applicant for
a stationary commercial fluid recycling facility to provide the Commission
with engineering, geological, or other information which the director
deems necessary to show that issuance of the permit will not result
in the waste of oil, gas, or geothermal resources, the pollution of
surface or subsurface water, or a threat to the public health or safety.
(b) Engineering and geologic work products prepared
by the applicant shall be sealed by a registered engineer or geologist,
respectively, as required by the Texas Occupations Code, Chapters
1001 and 1002.
