(a) An applicant may withdraw its application at any
time prior to issuance or renewal of the license or permit that is
the subject of the application or the denial of the application.
(b) If an applicant fails to respond to requests from
the TABC for additional information or for remittance of a license
or permit fee within ten (10) business days of the request, the TABC
may consider the application withdrawn by the applicant.
(c) An application that is withdrawn is not considered
denied and may be refiled at any time. Withdrawal of an application,
whether affirmatively by the applicant or due to the applicant's failure
to respond to requests for information or fees, does not trigger the
right to appeal or any other due process rights.
