| (a) This section applies to the export of malt beverages
that are not legal for sale in Texas under Alcoholic Beverage Code §§62.09,
64.09, and 66.11.
(b) The holder of any class of distributor's license
with the intent to receive, store, transport, and deliver for export
to another state malt beverages that are otherwise illegal to sell
to a Texas retailer because of alcohol content, container size, package,
or label shall:
(1) store and segregate the products separately from
products that are legal to sell to a Texas retailer;
(2) prepare a separate invoice for each transaction,
which shall be different from the invoice used for malt beverages
that are legal to sell to a Texas retailer; and
(3) maintain each invoice for at least two years and
make them available upon request by an authorized representative of
the commission.
