| (a) Each person required to be named in an application for a license under the Bingo Enabling Act is subject to a criminal history record inquiry. (b) Each person required to be named in an application for any license under the Bingo Enabling Act shall promptly furnish all information requested by the Commission to obtain criminal history record information from the Texas Department of Public Safety, Federal Bureau of Investigation, or other law enforcement agency. Falsification or nondisclosure of requested information shall result in the denial, revocation, or suspension of a license under the Bingo Enabling Act. (c) The existence of a disqualifying conviction on records obtained by the Commission is prima facie evidence of disqualification. The burden of proof is on the applicant to show otherwise. |
