| (a) If state appropriations for the program are insufficient
to allow grants to all eligible students, each institution shall give
priority to eligible students who have previously received a grant
through the program.
(b) In determining first-time recipients of grants
through the program, an institution shall give priority to those students
who have an expected family contribution that does not exceed 60 percent
of the average statewide amount of tuition and fees for general academic
teaching institutions, other than public state colleges, as the term
is defined in Texas Education Code, §61.003(16), for the relevant
academic year. The Coordinating Board shall determine and announce
this value for a given state fiscal year by January 31 of the prior
fiscal year.
(c) In determining first-time recipients of grants
through the program, an institution shall give highest priority to
eligible students meeting criteria specified under subsection §22.207(b)
(relating to Priorities in Grants to Students) who have also demonstrated
the highest levels of academic achievement prior to transfer as determined
by the participating institution.
