The following words and terms, when used in this subchapter, shall have the following meanings, unless the context clearly indicates otherwise: (1) Institution of Higher Education or Institution--Any public technical institute, public junior college, public senior college or university, medical or dental unit or other agency of higher education as defined in Texas Education Code, §61.003(8). (2) "University-affiliated bookstore"--A bookstore that: (A) sells textbooks for courses offered by an institution of higher education, regardless of whether the bookstore is located on the campus of the institution; (B) is operated by or with the approval of the institution through ownership, a management agreement, a lease or rental agreement, or otherwise; and (C) for the purposes of this subchapter, a "university-affiliated bookstore" also includes a bookstore similarly affiliated with any public institution of higher education as defined in paragraph (1) of this section. |
