(a) This subchapter establishes requirements and procedures
authorized or required by Texas Occupations Code, Chapters 55 and
651. Any requirements not provided in rule, but expressly set forth
in Chapters 55 and 651 referenced above, apply and must be followed
for the licensing of military service members, military veterans,
and military spouses.
(b) This subchapter does not modify or alter rights
that may be provided under federal law.
(c) Except as otherwise provided by this subchapter:
(1) a person applying for an apprenticeship license
as a funeral director and/or embalmer must comply with all of the
licensure requirements of §§203.5 - 203.7 of this chapter
(regarding the Provisional License; Provisional License Case and Reporting
Requirements; and Provisional License Reinstatement and Reapplication);
(2) a person applying for a full funeral director license
or embalmer license must comply with all of the requirements of §203.1
of this chapter (regarding Funeral Director and Embalmer License Requirements
and Procedure); and
(3) a person applying for the licenses listed in paragraphs
(1) and (2) of this subsection must comply with all of the requirements
in §§203.15 - 203.17 of this chapter (regarding Required
Notification of Criminal Conviction; Consequences of Criminal Conviction;
and Criminal History Evaluation Letter).
