(a) You must ensure that no one at your operation interferes
with an inspection or investigation by Licensing or an investigation
by the Department of Family and Protective Services (DFPS).
(b) You must ensure your operation:
(1) Admits the Licensing or DFPS representatives to
the operation;
(2) Provides access to all areas of the operation;
(3) Provides access to all records; and
(4) Does not delay or prevent the Licensing or DFPS
representatives from conducting an inspection or investigation.
(c) If anyone at your operation refuses to admit, refuses
access, or prevents or delays a Licensing or DFPS representative from
visiting, inspecting, or investigating the operation, Licensing may
take any or all of the following actions:
(1) Issue the operation a deficiency;
(2) Impose an enforcement action as specified in Subchapter
L of this chapter (relating to Enforcement Actions); or
(3) Seek a court order granting Licensing access to
the operation and records maintained by the operation.
