| (a) Notice of Intent (NOI) to prepare an EIS. When
the executive administrator recommends the issuance of an EIS, a NOI
will be published in the Texas Register in
order to provide the public with the opportunity to participate in
a scoping meeting.
(b) Contents of NOI. The NOI shall contain information
about a scoping meeting which shall be held no sooner than fifteen
days after the publication of the notice of intent. The public comment
period for the proposed scope of the EIS shall be at least forty-five
days.
