If the parties agree to use an assisted negotiation process, they shall
agree in writing to a detailed description of the process to be used prior
to engaging in the process. Any of the following methods, a combination of
these methods, or any other assisted negotiation process agreed to by the
parties, may be used in seeking resolution of claims and counterclaims:
(1) Mediation;
(2) Early evaluation by a third-party neutral;
(3) Neutral fact-finding by an expert;
(4) Mini-trial; or
(5) Any other alternative dispute resolution process agreed
to by the parties.
