RULE §1.71Disposition of Videotapes and Photographs

(a) All videotapes, photographs, and negatives created or acquired by Department of Public Safety personnel in the course of their official duties are agency property and available to the public as provided by the Texas Public Information Act. No employee shall sell, or offer to sell, any such videotape, photograph, or negative for personal gain, nor shall any employee receive any personal compensation whatsoever for the release or disposition of such items.

(b) This section is not intended to forbid the use of any such videotape, photograph, or negative by members of this department or other criminal justice agencies in the prosecution of any criminal or traffic case or in programs expressly intended to further public safety education or in any utilization approved by the director.
