RULE §27.141Entry by Clerk

(a) Texas Government Code, §411.0521, mandates the clerk of the court to provide to the department information relating to certain persons' access to firearms to be forwarded to the Federal Bureau of Investigation (FBI) for use in the National Instant Criminal Background Check System (NICS).

(b) Information submitted by the clerk will be in an electronic format entered via the department's Criminal Justice Information System (CJIS) website.

(c) The clerk of the court will enter the following information into the CJIS website:

  (1) the court originating agency identifier (ORI);

  (2) cause number;

  (3) first name;

  (4) middle name;

  (5) last name;

  (6) suffix;

  (7) date of birth;

  (8) sex;

  (9) race;

  (10) state identification number (SID);

  (11) driver license or personal identification number; and

  (12) social security number.

(d) Information should be forwarded to the department not later than the 30th day after an action of the court described by Texas Government Code, §411.0521.

(e) Federal prohibited person information submitted to the department will be provided to the FBI according to NICS/FBI Interface Control Document (ICD) specifications.
