(a) The JJAEP must conform to all applicable federal,
state, and local ordinances and codes. Each JJAEP must have on file
the most recent inspections (i.e., health and fire) conducted by the
local governmental authority having jurisdiction.
(b) The number of occupants in the JJAEP may not exceed
the rated capacity as determined by the appropriate fire authority.
The JJAEP must maintain documentation from the appropriate fire authority
for the rated capacity of each classroom and for the entire building.
(c) The classroom space and common areas must be adequate
to meet the programmatic requirements for each student enrolled and
in attendance in the JJAEP, including sufficient seating and desks
or tables.
(d) All fixtures, including any emergency lighting,
must be in working order.
(e) Repairs must be made promptly to all furniture,
equipment, and fixtures currently in use that are not in safe working
order.
