CHAPTER 151GENERAL PROVISIONS
RULE §151.77Purchasing and Contracting with Historically Underutilized Businesses

(a) The Texas Board of Criminal Justice (TBCJ) hereby adopts by reference the rules of the Texas Comptroller of Public Accounts codified in 34 Texas Administrative Code, Part 1, Chapter 20, Subchapter D, Division 1, relating to the Historically Underutilized Business (HUB) Program. The Texas Department of Criminal Justice shall comply with these rules and Texas Government Code §493.012.

(b) It is the intent of the TBCJ that all contracts for construction projects and for the purchase of goods and services be awarded in compliance with the applicable Texas purchasing laws, the Texas Constitution, and the United States Constitution. No preference shall be provided to a business except as provided by Texas Government Code §§2155.441 - 2155.453.
