The following words and terms, when used in this chapter, shall have the following meanings, unless the context clearly indicates otherwise. (1) Certification--A determination by the department that a facility meets the requirements for participation of the Title XVIII Medicare Program or the Title XIX Medical Assistance Program. (2) Department--The Texas Department of Human Services. (3) Facility--A long-term care institution which has applied for participation or participates in the Title XVIII Medicare Program or the Title XIX Medical Assistance Program. (4) HCFA--Health Care Financing Administration of the United States Department of Health and Human Services. (5) Intermediate care facility for the mentally retarded--A facility that participates in the Title XIX Medicaid Program under the definition in 42 United States Code (USC) §1396(d). (6) Nursing
facility--A facility that participates in the Title XIX Medicaid Program under the definition in 42 USC §1396(c). (7) Skilled nursing facility--A facility that participates in the Title XVIII Medicare Program under the definition in 42 USC §1395i-3(a). (8) Standards--The rules, requirements, and guidelines established by HCFA or the state Medicaid agency with which a facility must comply to participate in the Title XVIII Medicare Program or the Title XIX Medical Assistance Program. (9) State Medicaid agency--The state agency designated to administer the funds for the Title XIX Medical Assistance Program. (10) Title XVIII Medicare Program--The health insurance program for the aged and disabled authorized under Title XVIII of the Social Security Act. (11) Title XIX Medical Assistance Program--The medical assistance program in Texas authorized under Title XIX of the Social Security
Act.
