RULE §700.506Notification of Law Enforcement Agencies

The Texas Department of Family and Protective Services (DFPS) must notify appropriate law enforcement agencies of reports of child abuse or neglect within the following time frames:

  (1) DFPS must give notice within 24 hours of receiving a priority I report, a sexual abuse report, or a report alleging abuse or neglect in a public or private school. The initial notification may be provided using a method that is mutually agreed upon between DFPS and the law enforcement agency. This deadline applies even if subsequent information shows that the report is unfounded or does not qualify for priority I treatment. DFPS must follow up an initial oral notification with written notification within three days after receiving the report.

  (2) DFPS must send written notification of all other reports within three days of receiving them.

  (3) Reports submitted electronically are considered written notification for purposes of this section.
