(a) A request for access to case records must be submitted
on DFPS's Request for Records form. DFPS may waive the use of this
form or may request additional information not included on the form,
if appropriate under the circumstances surrounding a particular request.
(b) DFPS's Request for Records form provides additional
instructions regarding the proper filing of the request and any fees
that must be paid to obtain copies of the requested records. The methodology
for calculating fees is the same as that used by DFPS when responding
to any other request for records for which there is a charge.
(c) Upon receipt of a proper request for copies of
records, proof of the requester's identity, and a determination that
the requester is entitled to have access to those records, DFPS redacts
the case records as required, assesses necessary fees, and upon payment,
provides copies of the requested records, subject to the exceptions
described in this subchapter.
