(a) Persons authorized under this subchapter or other
law to have access to investigation records or case records may view
and or listen to any videotapes, audiotapes, or photographs which
are a part of the case record. Access to this category of records
is permitted in controlled areas, designated by DFPS, at a time mutually
convenient to the requester and DFPS. When viewing or listening to
these records, the requester may not be accompanied by any person
who would not otherwise be entitled to have access to these records,
unless DFPS determines the participation of this person is appropriate
under the circumstances surrounding the request.
(b) Copies of videotapes, audiotapes, and photographs
may be provided to the persons or entities by DFPS if provision of
a copy is essential to the investigation, prosecution, or resolution
of a case. Copies of videotapes, audiotapes, and photographs will
not be provided to any other person unless so ordered by a court pursuant
to Texas Human Resources Code, §48.101(c).
