(a) An employer has paid an employee's wages for purposes of the Act if the employer has delivered the wages to the employee: (1) in a form authorized by §61.016 of the Act; and (2) by a method authorized by §61.017 of the Act. (b) An employer has not paid an employee's wages for purposes of the Act if the employee has received the wages subject to a third party claim because: (1) the paycheck has been dishonored due to insufficient funds, a stop-payment order or any other reason attributable to the employer; (2) the employer has caused a direct deposit of the wages to be reversed; or (3) the employer has taken other similar action to undo the payment of wages.
