CHAPTER 10ETHICAL CONDUCT BY ENTITIES DOING BUSINESS WITH THE DEPARTMENT
SUBCHAPTER AGENERAL PROVISIONS
RULE §10.2Definitions

The following words and terms, when used in this chapter, have the following meanings, unless the context clearly indicates otherwise.

  (1) Commission--The Texas Transportation Commission.

  (2) Debarment--Disqualification of an entity from bidding on or entering into a contract with the department, from participating as a subcontractor under a contract with the department, and from participating as a supplier of materials or equipment to be used under a contract with the department.

  (3) Department--The Texas Department of Transportation.

  (4) Entity--A contractor, subcontractor, supplier, grantee, subgrantee, provider, subprovider, governmental agency, local government, or other business or governmental organization with which the department does business. The term does not include the federal government or an agency of the federal government.

  (5) Executive director--The executive director of the Texas Department of Transportation.

  (6) Reprimand--A written warning issued by the department that documents an act or omission committed by an entity.

  (7) Sanction--A consequence imposed on an entity for failure to comply with this chapter including reprimand, prohibition against participation in a specified agreement, or debarment.

  (8) Suspension--Immediate, temporary disqualification of an entity or individual from entering into or attempting to enter into an agreement with the department, from participating as a subcontractor under a contract with the department, and from participating as a supplier of materials or equipment to be used under a contract with the department.
